3. What Is the DMCA?

4. How to Submit a DMCA Takedown Notice

We aim to acknowledge all takedown notices within 2 business days and to act on valid notices within 5 business days of receipt.

6. Our Response Process

Upon receiving a notice that appears to be a valid DMCA takedown, News X Now will:

  1. Acknowledge receipt of the notice by email.
  2. Review the notice to assess whether it meets the requirements of 17 U.S.C. § 512(c)(3).
  3. Remove or disable access to the allegedly infringing content promptly if the notice is valid.
  4. Notify the user who posted the content that it has been removed or disabled, and provide them with a copy of the takedown notice.
  5. Inform that user of their right to submit a counter-notice if they believe the removal was made in error.

We reserve the right to reject notices that are incomplete, clearly erroneous, or submitted in bad faith.

7. How to Submit a Counter-Notice

If you believe that content was wrongly removed or disabled in response to a DMCA takedown notice — for example, because you have the right to use the content or because the notice was submitted in error — you may submit a counter-notice to our Designated Copyright Agent.

Under 17 U.S.C. § 512(g)(3), a valid counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or disabled and its location on our website before it was removed.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your full name, address, and telephone number.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which News X Now may be found).
  6. A statement that you will accept service of process from the person who submitted the original takedown notice, or their agent.

Upon receiving a valid counter-notice, we will forward it to the original complainant and inform them that the removed content may be restored within 10 to 14 business days unless the complainant files a court action to prevent the restoration, as required by 17 U.S.C. § 512(g)(2)(B).

Not all uses of copyrighted material constitute infringement. Before submitting a takedown notice, please consider whether the use of your content may be protected under:
